According to current regulations, families with children attending a preschool institution have the right to receive monetary compensation in a certain percentage of the required payment for the institution’s services.

The right to claim rights to compensation is vested in the child’s mother, father, or other guardian who has entered into an agreement with the kindergarten and pays money for the child’s stay there.

So for the first child 20% is due, for the second it is already half, and for the third and all subsequent ones - all 70%. In addition to the above, there are some categories of citizens who are provided with 50% compensation for their first child.

These include:

  • Chernobyl NPP liquidators;
  • MDOU employees;
  • conscripted military personnel;
  • disabled parents.

Separate compensation is provided for children of military personnel. So for the first and second children they will reimburse 80%, for the next 90%.

According to Federal Law No. 388, regions have the right to provide compensation based on criteria of need, that is, to leave payments at their discretion only for low-income people or for large families.

Therefore, you need to find out specifically what can be obtained in the preschool educational institution that the child attends.

In any case, the mother or father is required to provide the territorial social protection authority with a list of necessary documents and fill out the required application.

If the family has the right to a benefit (for example, liquidators of the Chernobyl accident), this must also be documented. Otherwise, the application will not be granted.

Governing laws

The rights to families receiving compensation for kindergarten are regulated by Federal Laws No. 273-FZ and No. 388-FZ, as well as No. 81-FZ.

The payment procedure is enshrined in Federal Law No. 76-FZ, also Order of the Ministry of Defense No. 555. Benefits for military families are enshrined in Order of the Ministry of Defense No. 862.

These are the main legal acts. In addition, the regions have developed other support programs, but they do not operate in all areas.

How is the payout amount calculated?

The compensation law applies to all citizens of the Russian Federation. But not all families will be able to claim compensation.

This is possible thanks to Law No. 388 Federal Law “On Amendments to Certain Legislative Acts” Russian Federation in terms of taking into account and improving the provision of social support measures based on the obligation to comply with the principle of targeting and application of need criteria” dated December 29, 2015.

It allows regional authorities to set a threshold for payments at their discretion. In many regions of the Russian Federation the main criterion is minimum size salary, on the basis of which family income is determined and criteria of need are established.

Important: in this case, to receive compensation, you must provide a certificate of family income for three calendar months.

The calculation takes into account the period actually spent by the son or daughter in the garden. If the child went to kindergarten for two weeks, then the costs will be reimbursed for two weeks, even if the parents paid the full monthly fee. To receive compensation, you must collect and write.

The amount of compensation is calculated according to the following principle:

  1. The cost of one day of stay in the institution is calculated (the teacher’s income is divided by the number of days of the month).
  2. The number of days the child actually spent in the institution is multiplied by the cost of a one-day stay.
  3. After this, the resulting number is divided by one hundred and multiplied by the coefficient (20, 50, 70).

You don’t have to divide by a hundred, but immediately multiply the result by 0.2, 0.5 or 0.7.

How much can you get?

Reimbursement for visiting the kindergarten depends on the number of children who go there and the amount of the cost. There is no single rule here; each region sets the size separately.

Read more about the procedure for paying compensation in.

In addition to compensation for families who pay for kindergarten services, There is also compensation for a child’s failure to attend a preschool educational institution in the event of a lack of places there..

But a similar program does not operate in all cities. For Krasnoyarsk this is 3 thousand 709 rubles. In Kirov it’s already less - 2 thousand 500 rubles. Perm residents have the right to expect 5 thousand 295 rubles for the lack of gardens, residents of Tomsk - 4 thousand, and Samara families - only one thousand rubles.

Example of compensation calculation

You can consider the calculation using the example of a specific family. The Ivanov family has three children: six years old, four years old and two years old. All three go to kindergarten, for which they have to pay a sum of 3 thousand rubles a month for each child to maintain children in the kindergarten.

How much money can you get? Having collected the necessary documents, mom will get 20% for the eldest- 600 rubles. For the average person it’s already one and a half thousand - that’s half the monthly cost. For the youngest 70%- this will amount to 2 thousand 100 rubles.

Adding everything together, it turns out 4 thousand 800 rubles. This will be the refund amount.

So, it turns out that in many regions of the Russian Federation, families with children have the right to receive compensation by providing the necessary documents. But the amount and criteria for receiving different regions are different, so you need to find out the specific amounts of compensation from the preschool educational institution that your child attends.

For several years now, throughout Russia, federal compensation has been paid for parental fees for part of children's preschool educational institutions (kindergartens). Regulation of the legal side of this procedure is based on the Law on Education (as amended in 1992). In this part, compensation for kindergarten is a strictly regulated procedure and a fairly effective tool.

Who is entitled to compensation for kindergarten?

The existing right to receive back a certain amount of money from the amount paid by the child’s parents for attending kindergarten.

This right to due compensation is exercised to the extent of the parent who signed an agreement with the kindergarten for the provision of preschool educational services, and also regularly makes monthly payments.

Such a person may also be the child’s legal representative.

This compensation for kindergarten in 2016 is aimed at significantly reducing the financial burden, primarily on the poor and large families, which is, of course, a very important task.

Various types of compensation payments for kindergarten

All payments from the state, as a rule, are intended to compensate the child’s parents only for a certain part of the payment they make, the amount of which depends entirely on how many children there are in the family. this moment there is time in the family.

There is also compensation for fees for an additional type of kindergarten, which covers food. Payment of this compensation is monthly, and its implementation applies only to persons who have the status of “Chernobyl victims,” that is, to persons who suffered during the Chernobyl accident and have all the documents confirming this fact.

Compensation for failure to provide kindergarten

Some regions of Russia, on their own initiative, also provided compensation for a place in kindergarten to parents whose children did not get a place in kindergarten. Let us recall that the implementation of the possibility of such compensation in all regions of the Russian Federation was considered back in 2011 in the State Duma, however, it was not adopted. In other words, compensation for not providing a kindergarten is currently not mandatory throughout the Russian Federation.

Thus, parental compensation for kindergarten may vary depending on the region, and needs to be more precisely clarified at the local level in each specific case.

The amount of compensation that parents receive for kindergarten

The amount that can be compensated for parental fees for kindergarten is calculated from the amount that parents pay each month for the child. Here also in mandatory the benefits that parents may have are also taken into account.

The basic rule for calculating the amount of compensation today is total number children (under 18 years old) living in the family:

  • If there is one child in the family, the compensation amount is 20%;
  • If there are two children in the family, the amount of compensation is 50%;
  • If there are three or more children in the family, the compensation amount is 70%.

Rules for processing compensation payments

The entire procedure for registration and payments, which is called compensation for part of the kindergarten fee, is today within the competence of Russian subjects, thus, any questions regarding this procedure are carried out at the level of regional authorities.

How to start the procedure

In order to start the procedure for processing documents to receive compensation for a kindergarten in 2016, you need to start collecting all the documents necessary for this, as well as make a request (you can contact it directly) to the head of the kindergarten.

Accrual

After all the formalities of the first stage have been complied with, a special department involved in the formation of compensation (usually at the regional, regional or republican level) calculates and subsequently pays refundable funds. The transfer of these funds is carried out to a personal account opened by the parents in any of the Russian banks (in most regions, payments are usually linked to Sberbank or large regional banks).

Cases of cancellation of payments

Let us note that in practice there are cases when compensation payments are canceled or a refusal to receive them occurs, even at the stage of document verification. This happens due to the fact that the authorities checking the documentation discover the falsity of the information provided by the applicants. Cancellation of compensation also occurs if the child drops out of kindergarten.

Interestingly, according to the current law, parents receive compensation for kindergarten in 2016, including for their child’s attendance at private kindergartens.

List of required documents in 2016

The moment of payment for the return of funds occurs, as mentioned above, after the parents or legal representatives of the child have collected the entire list of necessary documents, and the relevant authorities have established its accuracy.

The list of such documentation consists of six points:

  • A statement written to the head of the kindergarten, with information that the institution must make compensation payments;
  • A photocopy of the applicant’s identity document (first page and page with information about the place of registration);
  • A photocopy of the child's birth certificate. If the child has a legal representative, photocopies of the relevant agreement establishing the right of custody of the child should be provided.
  • Certificate of family composition (done by local authorities, from the house register);
  • A personal bank account issued in the name of the applicant, to which payments will be made in the future (a copy of the account certified by a bank seal is provided).

What do you need to know about compensation and taxes on it?

According to latest changes, which occurred in the tax legislation, regarding the payment of compensation for kindergarten, an amendment appeared regarding the tax that was previously imposed on it. From the beginning of 2015 to the present, personal income tax, which is currently 13%, no longer applies to this part of payments, that is, it does not take away part of the money returned to parents as compensation.

What compensation is provided for kindergarten for a child?

Parents whose children attend preschool educational institutions (or, more simply, kindergartens) are charged a parental fee.

The average amount of parental fees in state and municipal preschool institutions is established by the legislation of the constituent entity of the Russian Federation

Paragraph 2 of Article 65 of the Federal Law of December 29, 2012 N 273-FZ (as amended on June 4, 2014, as amended on June 4, 2014) “On Education in the Russian Federation” gives the founder of a preschool institution the right to establish the amount and procedure for payment for supervision and child care in kindergarten.

The law prohibits state and municipal kindergartens from including in parental fees the costs of the child receiving an educational program, as well as the costs of maintaining the property of the child care institution.

Paragraph 5 of Article 65 of the said Federal Law provides parents with compensation - a refund of part of the money paid for the supervision and care of a child in kindergarten.

Compensation is provided to parents whose children attend state, municipal, and private preschool institutions.

The main condition is that the preschool institution has a license for educational activities.

(Naturally, if parents are exempt from paying for kindergarten on the basis of some benefits, then they will not receive compensation.)

The amount of compensation provided is set independently in each constituent entity of the Russian Federation.

However, at the federal level a minimum amount has been established, below which compensation cannot be established:

  • for the first child - 20% of the average parental fee in state and municipal kindergartens of the corresponding subject of the Russian Federation;
  • for the second child – 50% of the parental fee;
  • for the third and subsequent child - 70% of the parental fee.
  • Based on Article 1 of Federal Law No. 124-FZ dated July 24, 1998 “On Basic Guarantees of the Rights of the Child in the Russian Federation,” a child is a person until he reaches the age of 18 years (the age of majority).

    To determine the amount of compensation, only minor children in the family are taken into account.

    To receive compensation, one of the parents (the one who entered into an agreement with the kindergarten) must prepare the following documents:

  • statement from the parent (sample – Appendix No. 1). Typically, the application form is attached to the regulatory act of the constituent entity of the Russian Federation, which establishes the amount and procedure for compensation, and is also posted on a stand for parents in preschool institutions.
  • copies of children's birth certificates;
  • a copy of the parent's passport;
  • bank details (account number) to which compensation will be transferred.
  • These documents, along with the originals, must be brought to the kindergarten that the child attends.

    The kindergarten administration will accept the documents, certify their copies and record the receipt of the documents in the appropriate journal.

    After this, the parent will receive compensation.

    Procedure for calculating compensation:

    The average amount of parental fees established in the relevant constituent entity of the Russian Federation must be divided by the number of working days in a month, multiplied by the number of days the child actually attends kindergarten and multiplied by the amount of compensation for part of the parental fee (set in %).

    For example:

    In April 2014 - 22 working days, of which the child attended kindergarten for 20 days.

    The average parental fee established in the region for calculating compensation is 1000 rubles.

    The compensation amount is 20%

    Let's do the calculation:

    1000 rub. / 22 x 20 x 20% = 181.82 rubles.

    The amount of compensation for parental fees in April 2014 will be 181.82 rubles.

    Not every parent can afford to independently raise their children before school. As a rule, the mother needs to go to work when the baby reaches 1.5-3 years old.

    The child is registered in kindergarten. But paying for a stay in a preschool educational institution can be quite significant for the family budget.

    Given this fact, the state is ready to reimburse part of the costs. How is compensation for kindergarten processed in 2019?

    General points

    Due to this, the cost differs. Article 65 of Federal Law No. 273 predetermines the amount of compensation for preschool education fees, and the amount of fees for kindergarten is also specified here.

    Maximum fee for staying in kindergarten:

    Regional authorities have the right to approve their own fee for preschool educational institutions, but no more maximum size according to federal law.

    At the same time, throughout the Russian Federation, parents of a child can receive a certain reimbursement of the monthly costs of paying for kindergarten.

    Federal law defines the limit of such compensation, but states that regions have the right to increase the amount of compensation at their own expense.

    For example, children who are paid for disability or a child from a low-income family can attend kindergarten for free if this is ratified by the law of the subject of the Russian Federation.

    It is worth noting that at the state level a bill was being considered to compensate for the lack of a place in a preschool educational institution. But such a law was not adopted.

    But the constituent entities of the Russian Federation have the opportunity to assign compensation at their level if the mother, due to lack of space in a daycare center, is forced to stay at home with a child of 1.5-6 years.

    So, from the moment of birth, the child must be registered with the Education Department at the place of residence, for the purpose of subsequent distribution to kindergartens.

    Moreover, children are first only registered. Upon reaching a certain age, the child, based on an application from the parents, is given a referral to a preschool educational institution with a free place at the family’s place of residence.

    How to calculate correctly

    • the number of children in the family who attend kindergarten;
    • average payment for visiting a preschool educational institution.

    It is important to understand that the total number of children in the family can be any; compensation is due only to those attending:

    To determine the average fee for visiting a preschool educational institution, the following calculation procedure is used:

    1. The total payment amount for the month is established.
    2. The number of working days in a month is determined.
    3. The total monthly payment is divided by the number of working days.
    4. The resulting amount is multiplied by the number of days the child actually spent in the child care facility.
    5. The percentage of compensation is calculated from the amount of actual payment made by the parents.
    6. The resulting value becomes the amount of the compensation payment transferred to the applicant’s personal account.

    When they list

    Compensation for payment for preschool education services is provided on an application basis. Therefore, if the parent did not apply in the prescribed manner, then compensation should not be expected.

    However, providing a compensation payment does not mean exemption from payments. Payment must be made according to the payment schedule and in full.

    If compensation for kindergarten has already been calculated, how is the amount paid when the compensation arrives?

    But compensation may be refused. For example, the reasons could be:

    • documents were not submitted by the preschool educational institution to the Department of Education in a timely manner;
    • parents are exempt from paying childcare;
    • the child care facility does not have the proper license.

    Nuances of registration through State Services

    You can apply for compensation for parental fees for kindergarten not only by personally contacting the management of the preschool educational institution. Parents have the right to submit an application through the State Services portal.

    To do this, you will need to register on the regional portal and be a registered user of the Russian Government Services portal.

    Here you can fill out the online application form, with scans attached. necessary documents. The application is sent directly to the Department of Education of the constituent entity of the Russian Federation.

    Document verification is carried out in the order of interdepartmental interaction with other structures.

    The result of the provision of the service is the provision of payment or a reduction in payment by the amount of compensation.

    For the second child

    All parents have the right to compensation for kindergarten fees. It does not matter when assigning payment financial condition families.

    But applicants often misunderstand the calculation procedure. So, in their opinion, 50% of the compensation should be paid for the second child in a family attending kindergarten, and 70% for the third.

    In fact, the amount of compensation depends on the number of children attending the kindergarten. If two children from the same family attend a child care institution, the payment will be reimbursed in half.

    But if only one child goes to the preschool educational institution, then compensation is assigned for one child in the amount of 20% of the payment.

    The total number of children in the family is not taken into account. Larger size compensation is allowed only if the corresponding norm is established at the regional level.
